He can't be on the Supreme Court- when was he ever a judge? He needs to be on a federal court first. So no worries there, unless I'm really badly mistaken about his resume.

Big fucking problem:

There are big noises happening about Ashcroft being the next appointed Supreme Court Justice after Rehnquist kicks the bucket or retires.

Apparently, constitutionally speaking there are no requirements for membership on the SCOTUS - you don't even have to be a lawyer. Current SCOTUS Chief Justice Rehnquist wasn't a judge. Chief Justice Warren wasn't a judge.

Wouldn't that be just fabulous.

No way would Congress allow it- a Supreme Court judge who's never been a judge? Even that asshat Scalia has an excellent idea of Constitutional law, though he's a hypocrite about following it.
